US Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Custody
A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.
The situation stems from a erroneous removal to El Salvador in March, which the government later admitted was an error. After his repatriation to the United States to answer human smuggling charges, he was held in immigration custody.
In her decision, the judge pointed out that the government does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
